PLANNING COMMISSION DISCUSSING TDR/HOME SIZE LIMITS

On August 29th the Boulder County Planning Commission kicked off a study of issues related to the proposed home size limit/transfer of development rights programs which will culminate with a draft ordinance by the end of 2007, if the current schedule holds. At the September study sessions, the Commission continued its discussion and focused on the definition of basement (which will be crucial in the calculation of home size limitations) and proposed changes to the Site Plan Review (SPR) process. The Planning Commission will continue to hold these study sessions
which are informational and include no opportunity for public comment -- until the County’s consultant Clarion & Associates completes its economic impact assessment study. According to Planner Michelle Krezek, it is unlike the Commission will have draft language for consideration in December: therefore she anticipates the County Commissioners may begin their review of the proposed ordinance in January 2008. BARA and the Longmont Association, under the NAR Land Use Initiative program, have engaged the Denver law firm of Fairfield and Woods, P.C. to assist us in analyzing these complex and controversial proposals.
